Tender description

This is a direct award to Zehnder CAS (Clean Air Solutions) to carry out maintenance of the Zehnder units within the PSD Scotland estate. Lot 1: The contract is awarded by direct award under section 14 of the Procurement Reform (Scotland) Act 2014. The maintenance service relates to Zehnder air filters containing the patented ‘Flimmer’ filter, which is exclusively manufactured and supplied by Zehnder. The patented nature of the filter means that no third‑party supplier can lawfully or technically provide the required maintenance service. As competition is genuinely absent for technical and exclusive rights reasons, and no reasonable alternative exists, a competitive procurement exercise would not deliver competition.
