Tender description

Orkney Islands Council as a statutory Planning Authority has the means to enter agreements with third parties under Section 75 of the Planning (Scotland) Act 1997 in order to restrict the use of land or regulate the use of land being developed where this is necessary to ensure that a development meets provisions associated with Planning decision. Such provisions may include financial provision through a bond or other means which the Planning Authority may call upon at a later date to ensure that remediation or other works which may be addressed in a planning condition are complete should the original developer no longer intend to discharge that condition. The Council wishes to commission specialist advisors to support a review of historic agreements; and to act as lead advisor to the Council in negotiating and framing future agreements where these are required. About the buyer

Orkney Islands Council is the local authority for the Orkney Islands, and buys through a dedicated procurement service led by a service manager. Contract opportunities are advertised on the Public Contracts Scotland Portal, with larger opportunities also published on Find a Tender. Construction works are sourced through a Dynamic Purchasing System open to approved contractors. Smaller purchases are assessed directly by individual council officers, with formal written quotations sought above a lower threshold. A public contracts register lists the council's current and past agreements. Suppliers must also meet a sustainable procurement policy covering environmental and social standards.

UK local government drives £140bn in annual procurement, led by social protection (£66.6bn) and education (£57.1bn).

Over the past 5 years, most of Orkney Islands Council's contract awards have been in repair and maintenance, transport equipment and architectural and engineering services.
