Description

East Suffolk and North Essex NHS Foundation Trust (the "Trust") intends to enter into a Landlord’s Licence for Alteration; Agreement for Underlease and Underlease with Noviniti Colchester Limited ("Noviniti") in respect of a retail development at Colchester General Hospital. The Trust has structured the contractual arrangement as a land transaction exempt from the Public Contracts Regulations 2015 and Directive 2014/24/EU. The Trust and Noviniti has entered into the Option Agreement and Ground Lease in respect of the site for the proposed retail development as detailed in the voluntary ex-ante transparency notice 2018/S 246-563190 published in the OJEU on 21.12.2018. Exempt land transaction falling outside the Public Procurement Regime as further described in Annex D1 of this notice or alternatively an award of works permitted on the basis of an exclusive right in land.
