Triangle Housing Association Ltd (‘THA’) intends to directly award a contract to Kelly Brothers Building Contractors LLP for ‘the works’ which comprise: (a) completion of 23 Nr dwellings and related infrastructure (including a sewage pumping station, drains, access road, fencing, landscaping, utility connections and commissioning of mechanical and electrical installations); and (b) designing the sewage pumping station and some other building elements. After competition via the eTendersNI platform the works were awarded to Forrme Ltd and were due to have been completed in September 2019. Due to factors beyond THA's control, Forrme was unable to complete the works so THA now needs them to be completed urgently. THA considers that it is entitled to award the works to Kelly Brothers Building Contractors LLP in accordance with Regulation 72(1)(c) of the Public Contract Regulations 2015, which allows contracting authorities to modify an existing contract without a new procurement procedure. Completion of 23 dwellings and related infrastructure (including a sewage pumping station, drains, access road, fencing, landscaping, utility connections and commissioning of mechanical and electrical installations). The contractor must also design the sewage pumping station and some other elements of the work.
