New Stavanger University Hospital — Voluntary ex-ante Transparency Notice for the Expansion of K2902 — Prefabricated Bathrooms

Helse Stavanger HF c/o Nye SUS announced Contract K2902 prefabricated bathrooms on 17 April 2018. This contract was for the delivery of prefabricated bathrooms for the New Stavanger University Hospital for wards/bed areas. HT Nordic AS won the contest and the contract was signed in February 2019. Due to challenges connected to interface, engineering design, assembly, etc., Helse Stavanger HF has to enter into a direct contract with HT Nordic AS in order to expand contract K2902 to include decontamination units that will be integrated in the prefabricated bathroom walls, which was not described in the original contract. See the technical justification for this under 'description of the procurement'. Lot 1: Justification for the voluntary ex-ante transparency notice for the expansion of K2902 prefabricated bathrooms. Nye SUS has procured prefabricated bathrooms in contract K2902 for standard patient rooms and contact infection isolation blocks in the ward buildings. The contact infection isolation blocks must be equipped with decontamination units. The decontamination units must be integrated in the bathroom walls and the adjoining prefabricated technical shaft. The detailed engineering design services and supplier engineering design services have shown challenges with ensuring flexible interface around the decontamination units as regards: — recesses and sealing in the German bathroom supplier's wall system; — limited space in the prefabricated shaft/pipe module behind the bathroom; — connections to water and sewage; — necessary order of assembly at the construction site. In order to engineer and construct the planned solution with an integrated decontamination unit, it is necessary to procure decontamination units from K2902's contract party HT Nordic AS, which has already adapted the wall system from the bathroom supplier. The equipment must be adapted in the factory in Germany and delivered together with the bathrooms in order to ensure all the required interface. Helse Stavanger HF and HT Nordic AS have signed a contract that includes delivery of prefabricated bathrooms, and the need for integration of decontamination units constitutes necessary additional deliveries that were not included in the original contract. Due to technical reasons, it is not possible to replace the supplier for the expansion, as the additional deliveries must be compatible with installations, etc., that were procured under the original contract. The expansion of the contract to include integrated decontamination units can be signed pursuant to the public procurement regulations, section 28-1 (1) letter c. The term is fulfilled as the supplier cannot be changed due to technical reasons. The reasons for expanding the existing contract are of both a technical and financial character, and are justified as the additional deliveries must be compatible and able to be integrated with the prefabricated bathrooms. Helse Stavanger HF assesses that this can only be done by the additional delivery being delivered by the contract party for the original contract, see the above justification. A change of supplier would lead to technical challenges as well as significant extra costs for the contracting authority, so this is not a feasible alternative. This voluntary ex-ante transparency notice is carried out in-line with Public Procurement Regulation section 21-5 c.f. section 28-1, first paragraph, letter c. The contract will be signed at the earliest 10 days after this notice is published.
