Description

The Land Development Agency (“LDA”) is a commercial State-sponsored body whose mission includes the provision of affordable and social housing to meet the needs of the State. It wishes to establish a panel (a “Framework”) of providers with expertise in residential development who are capable of delivering residential units, at scale, to the LDA. It is envisaged that suitable providers will comprise (i) experienced residential property developers and (ii) entities who have development expertise (or have access to development expertise) and who own or control suitable residential development land and who are partnering, joint venturing with, or sub-contracting to, building contractors with a track record and experience in the delivery of residential development. The type of transaction which may be called off under the Framework will primarily comprise forward funding style transactions (where the LDA acquires the land from the provider and thereafter makes interim payments to the provider in return for it carrying out development works). However, the Framework will also include other types of transaction, to include joint venture and partnering arrangements and contracts to provide works and/or services in respect of development on land owned or controlled by LDA. The LDA anticipates that over the life of the Framework up to 5,000 residential units will be capable of being delivered. Lot 1: The LDA wish to appoint a panel of providers, comprising (i) experienced residential property developers and (ii) entities who have development expertise (or have access to development expertise) and who have access (by way of ownership or some other proprietary interest) in suitable residential development land and who are partnering or joint venturing with, or sub-contracting to, building contractors with a track record and experience in the delivery of residential development. The target locations for the developments will be Dublin City, Dublin County, Kildare, Meath, Wicklow, Louth, Galway City, Cork City, Cork County, Waterford City, Waterford County, Limerick City, and Limerick County. Development land in prescribed towns in other locations where material population growth is predicted might also be suitable. The type of transaction which may be called off under the Framework will primarily comprise forward funding style transactions (where the LDA acquires the land from the provider and thereafter makes interim payments to the provider in return for it carrying out development works). However, the Framework will also include other types of transaction, to include joint venture structures and contracts to provide works and/or services on land owned or controlled by the LDA. The works and services to be provided may therefore include all development activities necessary in the preparation, design, finance, procurement, installation, commissioning, construction, completion and maintenance of works and associated infrastructure. It is anticipated that the Framework will have a term of up to four years, and that over such term up to 5000 residential units will be capable of being delivered. The competition is expected to be run under the competitive dialogue procedure of the Procurement Directive 2014/24/EU. It will be a two stage procurement process. The first stage will be a prequalification stage where the financial strength and experience of providers will be assessed following which up to 25 applicants will be shortlisted. The second stage will comprise those short listed applicants being invited to tender. As shall be more particularly set out in the tender documents, shortlisted applicants will be invited to tender based on an indicative scope of requirements against which they will provide certain technical and commercial responses. Following the tender assessment it is anticipated that not less than 10 successful applicants will be invited to join the Framework. Specific projects will be awarded based on the procedures established under the Framework. It is anticipated that call-offs under the Framework will commence soon after the establishment of the framework. This is a Prior Information Notice (PIN) and not a call for competition.
