Secondary school construction work

Description

Following the failure of the Social Infrastructure Development (SID) Framework. The Broxbourne School has awarded a contract to Chase Broxbourne School Ltd (CBS) for the sale of some of its land (the school having obtained secretary of state consent to sell) and development on that land of residential housing but with a building lease being granted to CBS of land on which new school buildings are to be constructed. The core commercial terms of the project call-off agreement used under the SID framework remain unchanged. The new school buildings are to form part of the consideration for the residential land. The transaction aggregates the land sale, the grant of the building lease, new school building works, and housing development into a single transaction. Broxbourne School has selected CBS pursuant to a negotiated procedure without prior publication on the basis of Article 32(2)(a) (no suitable tenders were submitted) and Article 32(2)(c) (strictly necessary where for reasons of extreme urgency brought about by unforeseeable events the time limits of other procedures cannot be complied with).
