THE PROCUREMENT DOCUMENTS BELOW ARE READ ONLY. DO NOT USE TO COMPLETE AND SUBMIT TENDER. PLEASE REGISTER AN INTEREST TO ACCESS PROCUREMENT DOCUMENTS TO COMPLETE AND SUBMIT. ONLY APPLICANTS WHO HAVE REGISTERED AN INTEREST WILL RECEIVE UPDATE NOTIFICATIONS. From 01 August 2015, to undertake the contracted grounds maintenance works for the Site at Oldway, for those areas identified within the attached Appendix A. The key for the plan is detailed in Appendix E which shows the specification of what needs to be maintained. The measurements for the plan are listed in Appendix B. TUPE applies to the Contract and it is recommended that Applicants take separate legal advice about TUPE. Applicants must complete and submit Appendix F Confidentiality Agreement through the electronic portal in order that TUPE information can be released to them. Oldway Mansion together with its ornamental gardens, recreation facilities and grounds is owned freehold by Torbay Council. There are leasehold interests in the two bowls facilities and a long lease of part to McCarthy & Stone for the Fernham part of the site. The Mansion and certain parts of the grounds are subject to a contract to a company called Oldway Mansion Ltd (OML) which is part of Akkeron Group PLC. Whilst the development is being undertaken Torbay Council will retain the controlling interest in the Management Company up until the moment in time that OML draws down a lease on the Mansion (the Mansion itself as distinct from the gardens & grounds). Torbay Council will therefore retain responsibility for ensuring the grounds maintenance works for the Site are still undertaken to the current high standard. In light of the fact the estate is now controlled by a Management Company it is necessary for the Contract to be re-tendered. The new Contract will be between the Supplier and the Oldway Facilities Management Company, set up by Torbay Council to manage the Site until the development is complete at which point the Management Company will be operated by the Developer (Oldway Mansion Ltd). The date of transfer is as yet uncertain. The Site is undergoing a phased development. Please refer to Appendix D for the current Development Plan and Appendix C for the Oldway Phasing Plan. When an area of the Site is to be developed it will come out of the Contract and once developed will come back into the Contract. However once it comes back in the specification of what needs to be maintained for the area will be different. A meeting will be held with the Contracting Organisation Authorised Officer when an area of land is coming in or out of the Contract in order to manage this change.
