Description

The competition is for a service concession user-controlled personal assistance (Norwegian abbreviation BPA) for users in the municipality. The contracting authority will continue the user choice scheme for user-controlled personal assistance (Norwegian abbreviation BPA) from September 2018. This means that users who have a decision on BPA can choose between private suppliers who have been awarded a concession. Therefore, the contracting authority invites tenderers to apply for award of concession in connection with the delivery of assistance hours in the scheme user-controlled personal assistance (Norwegian abbreviation BPA)for users in the municipality. The contract value is estimated to be above the EEA threshold. The estimated value is not binding for the contracting authority. The need is uncertain. As of March 2020, 80 419 decision hours of BPA were delivered to 20 users where 1 is under 18 years of age. The Contracting Authority does not pledge a specified volume, as changes in the need, activities, budget, and procedures may affect the total volume. Refer to the procurement documents for further information. Contract The contractual relationship is regulated by NS 8435: 2017, general contract provisions for user-controlled personal assistance (BPA) with associated forms A and B. NS 8435 General contract provisions for user-controlled personal assistance (BPA) must be purchased from Standard Norway (www.standard.no). No further contract shall be entered into between the user (supervisor) and the provide beyond what is stated in NS 8435 Form B. For form 8435 A the following are determined: Point 3: Form 8435 B is used for the individual assignment; Point 4: See the requirement specification and application with attachments; Point 5: The agreed price for the service appears in point 2.7. No fees can be charged; Point 6.1: The invoice must be marked as follows: the correct invoice must contain a clear description the provided service. The invoice must not contain the name of the user (Cosdoc number must be used). The provider's name/address and organisation number, order number (employee no.) name of the company, order number, if received by customer, delivery address, date of order and invoice and due date must always be stated. For purchase of service, the invoice must contain item number, item line description — a description of the delivered services to the municipality, the unit of measurements (hours), an overview of the number of hours worked, the subject area and the total sum. Point 6.2: the invoice must be sent to the contracting authority in electronic commerce format with a 30-days due date. Point 7: the following special provisions apply to the contract: Amendment to NS8435 point 7: the contract period is from 4 September 2020 to 31 December 2022. The contracting has an option for up to 3 years extension, for 12 months at a time. The parties have a mutual right for terminating the contract within 6 months from the first day of the next month. The contract period for a total of 8 years including extensions has been chosen due to the user's need for predictability and stability in the service. Amendment to NS8435 point 9.1: The index adjustment shall apply with effect from the first of January each year. In a BPA scheme, the user must approve the person/persons who shall provide the assistance. The use of the BPA scheme outside Norway can only be provided by a special agreement with the contracting authority. The contracting authority will check that the providers fulfil their obligations in accordance with the working environment act during the contract period. All private providers who are to be used for performing the service must have a collective wage agreement with their employees. The provider cannot use the contractual relationship with the contracting authority in marketing unless a separate agreement thereof has been signed. Logbook etc.: the provider must keep a journal in accordance with current regulations. The contracting authority shall, upon request, be given access to the journal except for when the user has objections thereof. The provider is obliged to present documentation showing that the work not subject to record keeping, is justifiable and in accordance with the current user decisions which enable the contracting authority that the services are provided correctly. When applicable, this documentation shall be provided as weekly reports or equivalent. If required, a separate data processor agreement must be implemented in accordance with new the General Data Protection Regulation (GDPR). The contracting authority expects that the tenderer study the contractual terms and makes the required internal clarifications in such a way that a contract can be signed if awarded.
