Description
The Health Service Executive (the “HSE”) intends to enter into a Contract for Sale with Adamstown Infrastructure DAC (or its nominee) (the “Vendor”) to purchase No. 1, Adamstown Boulevard, a premises on lands falling within the Adamstown Strategic Development Zone, Lucan, Dublin to be used as a healthcare facility/primary care centre (the “Premises”). As part of the proposed agreement the Vendor will complete significant fit-out works to the Premises in accordance with HSE clinical specification and that the cost of the works are estimated to exceed the applicable EU public procurement threshold for contracts of this nature. The HSE is of the view that it is justified in relying on the “absence of competition” derogation in Regulation 32 of the of the European Union (Award of Public Authority Contracts) Regulations 2016 to directly negotiate and award a contract to the Vendor without prior publication on the basis that the Premises is the only building in the area that is available and suitable to the needs and requirements of the HSE. The Premises falls within the Adamstown SDZ and there is no other facility within the SDZ that would be suitable following extensive HSE enquiries. Lot 1: The HSE intends to enter into a Contract for Sale with the Vendor to purchase a premises at No. 1, Adamstown Boulevard on lands falling within the Adamstown Strategic Development Zone, Lucan, Dublin to be used as a healthcare facility/primary care centre (the “Premises”). As part of the proposed agreement the Vendor will complete significant fit-out works to the property in accordance with HSE clinical specification The Vendor owns the premises (which is already built to shell and core stage) and has obtained planning consent as part of the Adamstown Strategic Development Zone for the construction and inclusion of a primary care centre as part of the overall development. The healthcare facility/primary care centre will be over 31,800 square feet in size (final measurement to be agreed) and there is public parking available in close proximity for clients and service users. The primary care centre will be delivered by the end of 2027. The transaction will proceed by means of a forward purchase, by way of Contract for Sale (to include refurbishment obligations). The HSE is aware of its obligations for the provision of Healthcare Services to all public patients and specifically in the context of the Adamstown PCC, the HSE’s intention is to provide only for Community & Primary Health Care services. Having made extensive enquiries and searches of the Lucan/ Adamstown area the HSE is of the view that the Vendor’s premises at No. 1, Adamstown Boulevard is the only building in the Adamstown Strategic Development Zone that is available and suitable to the needs and requirements of the HSE. The Premises falls within the Adamstown SDZ and there is no other facility within the SDZ that would be suitable following extensive HSE enquiries. The HSE is satisfied that no reasonable alternative or substitute exists. As such the HSE is of the view that is justified pursuant to Regulation 32(2)(b)(ii) of the European Union (Award of Public Authority Contracts) Regulations 2016 to award a contract directly to the Vendor on the basis that competition is absent for technical reasons. The proposed arrangement is subject to HSE Board approval. Negotiated procedure without prior publication in accordance with Regulation 32 of the European Union (Award of Public Authority Contracts) Regulations 2016. The works, supplies or services can only be provided by a particular economic operator for the following reason:. • Absence of competition for technical reasons. Explanation:.
