This Invitation to Tender (ITT)) is inviting Tenders for insurances coverage and associated services as required by Nottinghamshire County Council (the Contracting Authority) as detailed in Section 4 of this ITT (Services) where Information regarding the procurement process, the Services, and Award Criteria can be found. Lot 2: Property – Excluding Education Risk General Properties, Commercial Properties, Libraries Mutual Properties and Court of Protection Properties. General Properties/Libraries Mutual Properties Buildings, contents and stock in any building or temporarily removed therefrom (including stock in the open) belonging solely to the insured or held by them in trust for which they are responsible all within the territorial limits excluding Housing Properties and Education Properties. Commercial Properties Buildings Including :  landlord’s fixtures and fittings  outbuildings, yards, forecourts and car parks  roads and pavements, but only to the extent of the insured’s responsibility  walls, gates, fences, canopies and fixed signs  oil tanks, piping, ducting, cables, wires and associated control gear and accessories on the premises and extending to the public mains but only to the extent of the insured’s responsibility. Lot 3: Computer Damage caused to hardware owned, hired, leased or rented by the insured, if that damage arose during the period of insurance and while the hardware was at an insured location. Insured Event • damage to hardware; • loss, corruption, accidental or malicious deletion of or change to, unauthorised access to, or theft of data; • damage to websites, intranet or extranet sites; • failure of, or variation in, the supply of electricity or telecommunications networks owned and operated by you affecting your computer system, the computer system of a service provider or customer of yours; and • prevention of access. Definitions Computer Equipment Computers and associated equipment, telecommunications equipment and software and programs used to process data. Computer System Hardware, data, computer networks, websites, intranet and extranet sites. Reinstatement of Data The cost of investigating and reconfiguring your computer system and the computer system of a service provider (including the cost of restoring and recreating data) arising as a result of an insured event you discover during the period of insurance. Increased Cost of Working Extra costs to prevent or reduce the disruption to the functions carried out by your computer system during the indemnity period arising as a result of an insured event you discover during the period of insurance. Lot 5: Combined Liability – Excluding Education Risk Cover Indemnity against legal liability to pay compensation for bodily injury sustained by any employee arising out of and in the course of employment by the insured in connection with the business and caused during the period of insurance. Including:  Claimant’s Costs and Expenses;  Defence Costs and Expenses – including: c) costs of legal representation reasonably incurred with the insurer’s written consent at any: iii. coroner’s inquest or other inquiry in respect of any death iv. proceedings in any court (other than in the defence of criminal proceedings brought or in an appeal against conviction arising from such proceedings) in respect of any act or omission causing or relating to any occurrence d) other costs and expenses reasonably incurred with the insurer’s written consent in relation to any matter which may be the subject of indemnity. Policy Interest Policies are to be prepared in the name of Nottinghamshire County Council. Territorial Limits Great Britain, Northern Ireland, the Isle of Man or the Channel Islands and offshore installations in territorial waters around Great Britain and its continental shelf. Elsewhere in the world where any employee normally resident in the territories above is temporarily working in connection with the business. Lot 7: Motor Fleet – Excluding Education Risk Cover Third Party Only Policy Interest Policies are to be prepared in the name of Nottinghamshire County Council. Territorial Limits d) Great Britain, Northern Ireland, the Isle of Man and the Channel Islands; e) Any member of the European Union; f) Other countries for which the Commission of the European Union is satisfied that arrangements have been made to meet the requirements of EU Directives on insurance. In the case of (b) and (c) the minimum indemnity necessary to comply with the laws relating to compulsory insurance of motor vehicles (or, if higher, the law applicable as if the place where the insured vehicle was used when the event occurred were in Great Britain). Lot 8: Crime Cover • Employee Dishonesty - indemnity for loss arising from loss of assets resulting directly from any act of fraud or dishonesty committed on or after the retroactive date stated in the schedule by an employee acting alone or in collusion with others which is first discovered during the period of insurance • Computer Fraud and Funds Transfer Fraud – indemnity for loss by theft of: i. Assets due to any fraudulent or dishonest misuse or manipulation by a third party of the computer hardware, software programs or systems operated by the Council. ii. Funds or those for which the Council are responsible at law from an account maintained at a financial institution following fraudulent electronic, telegraphic, cable, telephone or written instructions to debit such account and to transfer, pay or deliver funds from such account and which instructions purport to have come from the council but which are fraudulently altered, transmitted or issued by a third party or are a forgery iii. Funds following authorised instructions from the Council to a financial institution holding funds in an account to set up new payee account details or alter the payee account details of a third party with which you already transact business where such payee account details are shown to be false and to have originated from a third party. £250,000 indemnity limit • Forgery and Counterfeiting - indemnity for loss of assets due to forgery or counterfeiting Policy Interest Policies are to be prepared in the name of Nottinghamshire County Council. Territorial Limits Great Britain, Northern Ireland, the Isle of Man and the Channel Islands. Definitions Assets Money, securities, goods or other property belonging to the insured or in the insured’s trust or custody for which the insured is legally responsible. Employee Any natural person who is: a) under a contract of service or apprenticeship with the insured; b) under a work experience or similar scheme; c) hired or borrowed by the insured from another employer and working for and while under the direct control or supervision of the insured or the insured’s relevant employee in connection with the business. Lot 10: Personal Accident / Travel – Excluding Education Risk Cover If an Insured Person sustains Bodily Injury during the Period of Insurance and Operative Time which within two years solely and independently of any other cause results in death, Disablement, or the incurring of Accident Medical Expenses, the insurer will pay the Insured the Sum Insured shown on the Schedule. Deductible £50,000 any one claim or series of claims arising out of a single event. £250,000 in the aggregate in any one period. Policy Interest Policies are to be prepared in the name of Nottinghamshire County Council.
