ForViva is procuring a Framework Agreement pursuant to which it is envisaged that contracts will be let to contractors within the framework for the provision of a range of new build construction and development projects (‘Development Contracts’). The Framework Agreement will be divided into 3 lots: Lot 1: Contractors — Call-off Contract value of less than 2 000 000 GBP; Lot 2: Contractors — Call-off Contract value of between 2 000 000 GBP and 5 000 000 GBP. Lot 3: Contractors — Call-off Contract value of more than 5 000 000 GBP. A summary of the types of contracts/projects that will be called-off under each of them and the total estimated value of these over the four year framework term is set out in the tender documentation. ForViva is procuring a Framework Agreement pursuant to which it is envisaged that contracts will be let to contractors within the framework for the provision of a range of new build construction and development projects (‘Development Contracts’). Under the Framework Agreement the following entities will have the option to call-off development contracts with individual framework contractors as and when works are required: (i) ForViva and any entity within the ForViva group from time to time, which currently includes City West Housing Trust (CWHT), Villages Housing Association (VHA) and ForWorks; (ii) Other social housing providers in the UK (both those that are in existence now and those that may be in existence in the future). ‘Social Housing Provider’ for this purpose means any provider of social housing and includes, without limitation, registered housing providers, local authorities and ALMOs. A list of the current social housing providers can be found by visiting https://www.gov.uk/government/publications/current-registered-providers-of-social-housing. Such social housing providers will only be entitled to call off under the Framework Agreement if ForViva consents. Bidders should note that, under the Framework Agreement, no entity will be under any obligation to call-off development contracts with framework contractors. The form of Framework Agreement that ForViva proposes to enter into with the successful contractors is set out at Appendix 2 of the ITT. It is envisaged that contracts called-off under this lot of the Framework Agreement will primarily be for the construction of residential housing, though may also include the construction of commercial properties and extra care facilities. The residential housing will primarily be affordable housing for rent, though may also include some mixed tenure housing. Contracts called-off under this Lot of the framework will be let on the basis of conventional industry standard form construction contracts such as the JCT design and build contract, the JCT standard building of contract and/or the NEC form of contract. Further details of the forms of contract are included within the tender documents. Contracts called-off under this Lot will each have a value of less than 2 000 000 GBP. Bidders should note that the estimated value of this lot as set out in this Notice is based on ForViva’s current anticipated requirements. This value may increase if other social housing providers decide to join and call-off under this lot of the Framework Agreement.
